We are Treatment Technologies & Insights, Inc. (“TTI”) (referred to as "TTI", "we", "us" and "our"). We are a corporation, registered in the United States of America, and based in Los Angeles, California. Our federal ID number is 82-5442058, and our registered office is at 300 Continental Blvd., STE 420, El Segundo CA 90245.

We provide and operate our websites at www.tti.care, www.wavehealth.app and www.chemoWave.com (our "Sites"). These are the terms and conditions of use for our Sites ("Site Terms"). We also provide the Wave Health App Platform ("Platform"), a digital healthcare solution for healthcare professionals, patients, and caregivers. Use of the Platform is governed by alternative terms, available here:

ACCESS & USAGE

TTI Sites are intended for individuals who are at least 18 years old. By utilizing our Sites, you affirm to us that you fulfill this age criteria, or if you are under the age of 18, you have obtained permission before accessing our Sites from your parent or legal guardian.

Utilization of our Sites is limited to devices that are either owned or under the control of you or your Company. Before accessing our Sites on a device that you do not own (such as a company computer), it is imperative that you first obtain permission from the device owner. It is your responsibility, as stated in these Site Terms, to guarantee that any access and use of our Sites on the device, regardless of ownership, complies with the Terms.

You may only access and use our Sites on a device owned or controlled by you or your Company. If you access and use our Sites on a device which you control but do not own (e.g. a company computer), you must have permission from the device owner to do so. You are personally responsible, under these Site Terms, for any access and use of our Sites on any device (whether or notwhether it is or is not owned by you).

You are solely responsible for ensuring that any device or equipment you use to access any of our Sites (such as a computer or mobile device), is compatible with the Site and that it meets all the required technical specifications.

We cannot guarantee the uninterrupted, or error-free operability of our Sites. There may be times our Sites or certain aspects of our Sites become unavailable (on a scheduled or unscheduled basis) or are modified, suspended, or withdrawn by us, in our sole discretion, without notice to you. You agree that TTI will not be held liable to you or to any third party for any unavailability, modification, suspension or withdrawal of our Sites, or any features, parts, or content of our Sites.

Additionally, we reserve the right to restrict access to TTI Services to users who have registered with us, including any of our Sites and/or certain content or features on a specific Site.  To become a registered user, it is your personal responsibility to ensure that any details you provide are accurate. To comply with TTI’s security policies and procedures, it is mandatory that you treat any information provided to you or chosen by you for accessing a TTI Site (such as an access code, ID number, log-in credential, username, password, or other identifiers), as confidential information and that your refrain from disclosing it to any other individuals. You accept responsibility for all activities that occur under your log-in credentials, and you must notify TTI immediately of any unauthorized use or other security breach of which you become aware. We reserve the right to disable any log-in credential, at any time, if in our opinion you have failed to comply with any of the provisions of these Site Terms or if any details you provide for the purposes of registering as a user prove to be false.

 

CONTENT

TTI is not a healthcare provider. We own and operate a communication platform and are not responsible for any of the information, including the accuracy of such information, communicated through it by healthcare professionals, patients, and caregivers.

You agree that your use of our Sites is on an 'as is' and 'as available' basis and at your sole risk. While we make efforts to ensure that all information contained on our Sites (other than any user- generated content) is correct, it is not intended to amount to authority or advice on which reliance should be placed. You should check with us or the relevant information source before acting on any such information.

Except as set out in these Terms, we cannot and do not make any guarantees as to the accuracy, completeness, currency, correctness, reliability, integrity, quality, fitness for purpose or originality of any content of our Sites and, to the fullest extent permitted by law, all implied warranties, conditions or other terms of any kind are hereby excluded and we accept no liability for any loss or damage of any kind incurred as a result of you or anyone else using our Sites or relying on any related content.

We cannot and do not guarantee that any content of our Sites will be free from viruses and/or other code that may have contaminated or destructive elements. It is your responsibility to implement appropriate IT security safeguards (including anti-virus and other security checks) to satisfy your requirements as to the safety and reliability of content.)

 

INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights in any content of the Site (including text, graphics, software, photographs and other images, videos, sound, trademarks, and logos) are owned by us or our licensors. Nothing in these Site Terms gives you any rights in respect of any intellectual property owned by us or our licensors and you acknowledge that you do not acquire any ownership rights by downloading content from our Sites. In the event you print, copy or store pages from the Site (only as permitted by these Terms), you must ensure that any copyright, trademark, or other intellectual property right notices contained in the original content are reproduced.

 

EXTERNAL LINKS

From time to time, our Sites may include links to external sites that include third party offers or promotions to information, products or services users may find helpful or interesting. Links to such external sites does not imply any association with or endorsement of 3rd party operators or promoters. Furthermore, TTI is not responsible for the content, or anything provided by these external sites and does not guarantee they will be continuously available.

 

PERMISSIONS & RESTRICTIONS

You may only use our Sites in accordance with these terms and conditions. You may retrieve and display content from our Sites on a computer screen, print and copy individual pages and, subject to the next section, store such pages in electronic form. Additional terms may also apply to certain features, parts or content of our Sites and, where they apply, will be displayed on-screen or accessible via a link.

Except to the extent expressly set out in these Terms, you are not allowed to: (1) store content of our Sites on a server or other storage device connected to a network or create an electronic database by systematically downloading and storing all of the content of the Site; (2) remove or change any content of the Site or attempt to circumvent security or interfere with the proper working of our Sites or the servers on which it is hosted; or (3) create links to our Sites from any other website, without our prior written consent, although you may link from a website that is operated by you provided the link is not misleading or deceptive and fairly indicates its destination, you do not imply that we endorse you, your website, or any products or services you offer, you link to (and do not frame or replicate) any home page of our Sites, and the linked website does not contain any content that is unlawful, threatening, abusive, defamatory, pornographic, obscene, vulgar, indecent, offensive or which infringes on the intellectual property rights or other rights of any third party.

You must only use our Sites and anything available from our Sites for lawful purposes (complying with all applicable laws and regulations), in a responsible manner, and not in a way that might damage TTI’s name or reputation or that of any TTI affiliates.

All rights granted to you under these Site Terms will terminate immediately in the event that you are in breach of any of them.

 

LIABILITY

We are not excluded from any liability for a circumstance that may not be limited or excluded by law, including: (1) instances of fraudulent misrepresentation; (2) cases of personal injury or death caused by our negligence; (3) a breach of any term implied by the Consumer Rights Act 2015, where such limitation or exclusion is prohibited by law.

Subject to the above, if you are a business user, we shall not be liable to you for any indirect or consequential losses, or for any loss of profit, revenue, contracts, data, goodwill, or similar losses. Any liability we do have for losses you incur is strictly limited to losses that were reasonably foreseeable. We shall not be liable to you for any business losses if you are a consumer (not a business user).

These terms and conditions are governed by the laws of the United States of America. You consent that any dispute between you and TTI concerning these Terms will be exclusively resolved in courts located in the USA.
